Terms of Service

1. Acceptance

By creating an account or using Caunsh ("the Service"), you agree to these Terms of Service ("Terms"). The Service is operated by Jodi Anoorabh LLP, an Indian limited liability partnership ("we", "us", "Company").

If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Eligibility

• You must be at least 13 years old.
• You must provide accurate registration information and keep your credentials secure.
• You are responsible for activity under your account.

3. The Service

Caunsh is a personal life management application. It includes tools such as tasks, habits, goals, journal, notes (including linked notes and search), relationships, finance views, calendar-oriented views, weekly digest email (on supported plans), and an AI assistant ("Caunsh AI") that can process your requests using Google Gemini via our infrastructure (including Cloudflare Workers for routing and related processing).

Features may evolve. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable. We are not liable to you or third parties for changes that are typical for a cloud-hosted product, except where applicable law requires otherwise.

4. Plans, billing, and AI limits

4.1 Plans and list prices (INR)

The Service is offered in three tiers. The plan fees below are in Indian Rupees and match the list amounts we show in-app (e.g. Settings → Subscription / upgrade). They are shown before tax. Applicable taxes (such as GST) are calculated and displayed on the Razorpay checkout and on your receipt or invoice—you pay the total amount shown there.

• Free (Free): ₹0. Includes core modules with a monthly AI token budget of 1,00,000 tokens (resets each billing cycle).
• Plus: ₹333 per month, or ₹3,333 per year when billed annually. Monthly AI token budget 5,00,000 tokens. Includes features such as weekly digest, data export, and advanced analytics as described in-app.
• Pro: ₹999 per month, or ₹9,999 per year when billed annually. Monthly AI token budget 15,00,000 tokens. Same broad paid feature set as Plus unless otherwise shown in-app.

AI usage is metered in tokens per cycle (chat, voice, insights, mood analysis, and similar features consume from the same budget)—not a simple "message count". If checkout shows a different total than the list fee (for example because of coupons, proration, or tax rounding), the amount you authorise on Razorpay controls for that transaction.

We may change list prices or token budgets with at least 30 days' notice to active paid subscribers (for example by email or in-app). Prepaid annual plans keep the price for the term you already paid.

4.2 Billing

• Paid plans are billed through Razorpay (monthly or yearly, as selected).
• Subscriptions renew automatically unless cancelled before renewal.
• Taxes (e.g. GST) are added at checkout on top of the plan fee where applicable, unless the payment screen explicitly states that a figure is all-inclusive.
• Refunds for partial periods are not guaranteed unless required by applicable law.

4.3 Cancellation

Cancel from Settings → Subscription (or equivalent). Paid features typically remain available until the end of the paid period.

4.4 Failed payments

If payment fails, Razorpay may retry according to its rules. If payment cannot be collected, your subscription may end and your account may revert to a free tier. Your stored content generally remains accessible subject to free-tier limits and these Terms.

5. Acceptable use

You agree not to:

• Violate law or infringe others' rights.
• Attempt unauthorised access to the Service, other accounts, or underlying systems.
• Reverse-engineer or circumvent security or usage limits (including AI token limits).
• Use bots or scrapers at scale without permission.
• Upload malware or abuse the Service in a way that harms infrastructure or other users.

6. Your content

You retain ownership of content you create. You grant us a limited licence to host, process, back up, and display that content solely to operate the Service—including sending portions to AI providers when you use AI features, and storing attachments on our storage providers.

7. AI disclaimer

AI output may be wrong, incomplete, or inappropriate. Do not rely on it for medical, legal, financial, or other professional decisions. We are not liable for decisions you make based on AI output. See our Privacy Policy for how AI processing works.

8. Privacy

Our Privacy Policy explains how we collect and use data and is incorporated by reference. Export and deletion options are described there and in-product.

9. Availability

We strive for reliability but do not guarantee uninterrupted access. Maintenance and third-party outages may occur.

10. Intellectual property

The Service (software, branding, and our materials) is owned by Jodi Anoorabh LLP or licensors. You may not copy or redistribute it except as allowed by law or written permission.

11. Termination

We may suspend or terminate accounts for serious breaches. You may stop using the Service at any time. Provisions that should survive (e.g. liability limits, governing law) survive termination.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total liability for claims relating to the Service is limited to the greater of (a) fees you paid us in the three months before the claim, or (b) ₹1,000, except where Indian law does not permit such a cap.

13. Governing law

These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction, subject to mandatory consumer protections.

14. Changes

We may update these Terms. Material changes will be communicated by email or in-app notice when reasonable. Continued use after the effective date constitutes acceptance unless you stop using the Service and close your account.
